Infringement notice

If you believe content on MILK infringes your copyright, send the agent a notice that includes:

  1. Your physical or electronic signature.
  2. Identification of the copyrighted work you say is infringed.
  3. Identification of the material on MILK you want removed, with enough detail for us to find it (for example, the member ID and the photo or post).
  4. Your name, address, phone number and email.
  5. A statement that you have a good-faith belief the use is not authorized by the owner, its agent or the law.
  6. A statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner.

Counter-notice

If your content was removed and you believe it was a mistake or misidentification, you may send the agent a counter-notice under 17 U.S.C. § 512(g)(3). It must include your signature, the removed material and where it appeared, a statement under penalty of perjury that it was removed by mistake or misidentification, your name, address and phone number, and your consent to the jurisdiction of the federal district court for your address (or, outside the U.S., any district where MILK may be found) and to accept service from the person who filed the notice. MILK may restore the material 10 to 14 business days after receiving a valid counter-notice unless the complainant tells us they have filed suit.

Repeat infringers

MILK will terminate, in appropriate circumstances, the accounts of members who repeatedly infringe.

False claims

Knowingly misrepresenting that material is infringing, or that it was removed by mistake, can make you liable for damages under 17 U.S.C. § 512(f).
